These Terms of Use ("Terms") govern the rights and obligations relating to the use of the DentAI (DentalPreview) application and its management panel. By using the App, you accept these Terms.

1. Parties

  • Service Provider: Onda Webs ("Operator")
  • User: Clinic staff using the App (dentist, assistant, administrator) or the patient

2. Description of Service

DentAI is an application and management panel designed for dental clinics. Core functions:

  • Capturing the patient's facial photograph
  • Generating AI-based before/after dental/smile simulations
  • Keeping case records
  • Managing in-clinic AI preference settings

3. Important Medical Notice

The App is not a medical device. The AI-generated image is for visualization purposes only and does not guarantee a treatment outcome. The final treatment plan is determined solely by the professional assessment of a licensed dentist.

4. Conditions of Use

While using the App, the User agrees to:

1. Use it only for lawful purposes,

2. Not enter patient data without the patient's explicit consent,

3. Not share account credentials,

4. Not reverse-engineer or misuse the App,

5. Not attempt unauthorized access to other users' data.

5. Account Security

  • Password security is the User's responsibility
  • Suspected unauthorized access must be reported immediately to destek@ondawebs.com
  • The session is automatically closed after 5 minutes of inactivity (for clinic staff)
  • Sensitive actions (Settings access) require biometric / password re-authentication

6. Intellectual Property

The software, brand, logo, content and all components of DentAI belong to Onda Webs and are protected under applicable intellectual-property law.

7. Service Interruptions

The Operator reserves the right to temporarily suspend the App without prior notice (maintenance, security, legal requirement).

8. Limitation of Liability

The Operator states that:

  • The AI simulation does not guarantee a treatment outcome,
  • It is not responsible for interruptions originating from third-party services (Google, Apple),
  • It is relieved of performance in cases of force majeure (regulatory change, natural disaster, etc.).

Cases of direct intent or gross negligence are reserved.

9. Governing Law and Jurisdiction

These Terms are governed by the laws of the Republic of Türkiye. The Istanbul Courts and Enforcement Offices have jurisdiction over disputes.

10. Changes

These Terms may be updated. For material changes, an in-app notice is shown and the acceptance screen is displayed again.

Kullanım Koşulları (Türkçe)

İşbu Kullanım Koşulları ("Koşullar"), DentAI (DentalPreview) uygulamasının ve yönetim panelinin kullanımına ilişkin hak ve yükümlülükleri düzenler. Uygulamayı kullanarak bu Koşulları kabul etmiş sayılırsınız.

1. Taraflar

  • Hizmet Sağlayıcı: Onda Webs ("Operatör")
  • Kullanıcı: Uygulamayı kullanan klinik personeli (doktor, asistan, yönetici) veya hasta

2. Hizmet Tanımı

DentAI, diş klinikleri için tasarlanmış bir uygulama ve yönetim panelidir. Temel işlevler:

  • Hasta yüz fotoğrafının çekilmesi
  • AI tabanlı diş/gülümseme öncesi/sonrası simülasyonu üretilmesi
  • Vaka kaydı tutulması
  • Klinik içi AI tercih ayarlarının yönetilmesi

3. Önemli Tıbbi Uyarı

Uygulama bir tıbbi cihaz değildir. AI tarafından üretilen görsel; görselleştirme amaçlıdır, tedavi sonucunu garanti etmez. Nihai tedavi planı yalnızca lisanslı diş hekiminin profesyonel değerlendirmesi sonucu belirlenir.

4. Kullanım Şartları

Kullanıcı, uygulamayı kullanırken:

1. Yalnızca yasal amaçlarla kullanacağını,

2. Hasta verisini hastanın açık rızası olmadan girmeyeceğini,

3. Hesap bilgilerini paylaşmayacağını,

4. Uygulamayı tersine mühendislik / kötüye kullanım amacıyla kullanmayacağını,

5. Diğer kullanıcıların verilerine yetkisiz erişim denemeyeceğini

kabul ve taahhüt eder.

5. Hesap Güvenliği

  • Şifre güvenliği kullanıcının sorumluluğundadır
  • Yetkisiz erişim şüphesi olduğunda derhal destek@ondawebs.com adresine bildirim yapılmalıdır
  • 5 dakika hareketsizlikten sonra oturum otomatik kapatılır (klinik personeli için)
  • Hassas işlemler (Ayarlar erişimi) için biyometrik / şifre yeniden doğrulama istenir

6. Fikri Mülkiyet

DentAI'nin yazılım, marka, logo, içerik ve tüm bileşenleri Onda Webs'e ait olup, 5846 sayılı Fikir ve Sanat Eserleri Kanunu ile Sınai Mülkiyet Kanunu kapsamında korunmaktadır.

7. Hizmet Kesintileri

Operatör, uygulamayı önceden bildirim yapmaksızın geçici olarak askıya alma hakkını saklı tutar (bakım, güvenlik, yasal zorunluluk).

8. Sorumluluğun Sınırlandırılması

Operatör:

  • AI simülasyonun tedavi sonucu garantisi vermediğini
  • Üçüncü taraf hizmetlerden (Google, Apple) kaynaklanan kesintilerden sorumlu olmadığını
  • Mücbir sebep (mevzuat değişikliği, doğal afet, vb.) hallerinde edim borcundan kurtulduğunu

beyan eder. Doğrudan kasıt veya ağır ihmal halleri saklıdır.

9. Uygulanacak Hukuk ve Yetki

İşbu Koşullara Türkiye Cumhuriyeti hukuku uygulanır. Anlaşmazlıklarda İstanbul Mahkemeleri ve İcra Müdürlükleri yetkilidir.

10. Değişiklikler

Koşullar güncellenebilir. Esaslı değişikliklerde uygulama içi bildirim yapılır ve kabul ekranı tekrar gösterilir.
